General conditions of sale and use
Article 1: Designation of the seller
These General Terms and Conditions of Sale (hereinafter "GTC") are concluded between, on the one hand, HYLÉRIA, SAS with capital of €18,000 registered with the RCS of Chartres under number 902 755 131, having its registered office at 50 rue Chanzy 28 000 Chartres, and on the other hand, any person having made a purchase on the site https://hyleriaparis.com, hereinafter referred to as "the Customer".
Article 2: General provisions relating to the General Terms and Conditions
2.1 Purpose of the T&Cs
The purpose of these General Terms and Conditions is to define the conditions under which Customers can access the Site, place Orders, manage relations between HYLÉRIA and its Customers, and to detail the rights and obligations of HYLÉRIA.
2.2 Scope of application of the General Terms and Conditions
The General Terms and Conditions apply to the relationship between Customers and HYLÉRIA. Any Customer placing an order undertakes to comply with these General Terms and Conditions without reservation.
2.3 Modification of the T&Cs
These General Terms and Conditions were updated on April 22, 2024. HYLÉRIA is free to modify these General Terms and Conditions at any time and without notice, in particular to take into account any legal, jurisprudential and/or technical developments. In the event of modification of the applicable General Terms and Conditions, those in force at the time of the order placed by the Customer remain the same.
2.4 Clauses of the T&Cs
The invalidity of a contractual clause does not entail the invalidity of the General Terms and Conditions. The temporary or permanent non-application of one or more clauses of the General Terms and Conditions by the professional seller cannot constitute a waiver on its part of the other clauses of the General Terms and Conditions, which continue to produce their effects.
Article 3: Price
3.1 Sale price
The sales prices, in accordance with Article L. 112-1 of the Consumer Code, are indicated, for each of the products appearing in the electronic catalogue, in euros including all taxes, excluding delivery and transport costs mentioned before validation of the order and invoiced in addition.
The total amount due by the consumer is indicated on the order confirmation page.
The sale price of the product is that in effect on the day of the order.
The sale price of the products does not include shipping costs charged in addition to the price, nor customs taxes if applicable.
3.2 Modification of sales prices
HYLÉRIA reserves the right to modify its prices at any time, while guaranteeing the consumer the application of the price in effect on the day of the order.
3.3 Fees
Additional transport, delivery or postage costs (to which must be added any other costs incurred by the seller), which the customer may have been aware of before ordering, are set out on the order form. Certain customs taxes applied at the border may be applied by the competent authorities, without HYLÉRIA being informed and being held responsible.
Article 4: Products
4.1 Presentation of the articles
The articles are described as precisely and accurately as possible, mentioning their essential characteristics within the meaning of Article L. 111-1 of the French Consumer Code. The Customer is informed that photographs of the Products appear on the Site, which they may consult freely. HYLÉRIA undertakes to ensure that the photographs of the products are as consistent as possible with the products that will actually be delivered to Customers, but these do not constitute a contractual document. However, subject to providing a faithful presentation of the essential qualities of its Products, HYLÉRIA cannot guarantee the exhaustive communication of all the characteristics of each Product.
4.2 Use of the products
HYLÉRIA offers cosmetic products for sale to Customers. HYLÉRIA undertakes to provide Customers with all the necessary information for the proper use of its cosmetic products. HYLÉRIA cannot be held liable for any damage caused by improper use of the products sold on its website or by failure to follow the precautions for use.
4.3 Compliance
The products sold by HYLÉRIA comply with the requirements of French law in force relating to the safety and health of people, the fairness of commercial transactions and the protection of consumers at the time they are placed on the market.
4.4 Availability
The products are offered and delivered within the limits of available stocks. In the event of unavailability of the ordered products, HYLÉRIA undertakes to immediately inform the Customer, and to offer them equivalent products or a voucher for the amount of the order that can be used for any future order. In the event of persistent disagreement with the Customer, HYLÉRIA undertakes to reimburse the Customer for the amount of their order within 5 working days. Apart from the reimbursement of the price of the unavailable product, HYLÉRIA is not liable for any cancellation compensation, unless the non-performance of the contract is personally attributable to it.
4.5 Resale of products
The Customer is required not to resell the products ordered on the site without the written consent of HYLÉRIA.
Article 5: Order
5.1 Order process
The Customer fills a virtual shopping cart with the products they have selected. They can then check the details of their order. The Customer can then click on the "Place order" or "Order" button and add information relating to the delivery method and payment method. Before clicking on the "Confirm order" button, the consumer has the opportunity to check the details of their order and its total price and to return to the previous pages to correct any errors or possibly modify their order. Confirmation of the order implies acceptance of the General Terms and Conditions and forms the contract. The Customer will then receive an email confirming receipt of the order by HYLÉRIA.
5.2 Modification of an order
HYLÉRIA reserves the right to accept or reject the modification of a Customer's order after its confirmation. HYLÉRIA reserves the right to make modifications to the ordered product that are linked to technical developments under the conditions provided for in Article R. 212-4 of the Consumer Code.
5.3 Validation of an order
HYLÉRIA reserves the right to refuse any order for legitimate reasons, particularly if the quantities of products ordered are abnormally high for buyers who are consumers. HYLÉRIA may also refuse or delay processing an order if any fraud is suspected, such as identity theft or theft of payment methods.
Article 6: Payment
6.1 Due Date
Once the order is validated, the Customer automatically accepts the General Terms and Conditions of Sale. The price is due in full after confirmation of the order. Payment is made immediately upon ordering by credit card.
6.2. Payment methods
He then pays on the site https://hyleriaparis.com by credit card (CB, Visa or Mastercard).
In the event of payment by payment via Paypal, the payment terms are specific to the Paypal payment service provider platform, and are independent of HYLÉRIA, which does not intervene in any way in the use of said service. All terms and conditions related to payment via the Paypal payment solution are governed by the General Terms of Use of this service, accessible at the address https://www.paypal.com/fr/webapps/mpp/ua/useragreement-full, which apply concurrently to these General Terms and Conditions. HYLÉRIA does not store any of the Customer's bank details, subject to the provisions below. HYLÉRIA cannot be held responsible for any malfunction occurring on the Paypal payment platform. By accepting these terms and conditions, the Customer also agrees to be bound by the Paypal General Terms and Conditions of Use, accessible at the aforementioned address. These may be subject to modifications by Paypal only. Under no circumstances may HYLÉRIA modify the General Conditions of Use of Paypal, a service provider over which it has no control.
6.2 Secure payment
The HYLÉRIA website is equipped with an online payment security system that allows the Customer to encrypt the transmission of their banking data via the secure payment platform's electronic payment server. At no time will the consumer's banking data pass through the HYLÉRIA computer system.
6.3 Verified Payment
In the event of abusive practices and/or fraudulent appearance, HYLÉRIA reserves the right to carry out checks on orders, and to request certain documents and information concerning the Customer in order to validate the order.
Article 7: Delivery
7.1 Delivery costs
Delivery costs are explicitly specified on the website https://hyleriaparis.com, the amount of delivery costs may vary depending on the delivery address of the order.
7.2 Delivery time
The delivery time depends on the delivery method chosen by the Customer, as indicated on the website at the time of ordering. The delivery times for an order include its preparation, dispatch, and delivery to the delivery address specified by the Customer.
Under normal conditions, HYLÉRIA will process the order as quickly as possible from Monday to Friday, excluding public holidays.
In order to facilitate the delivery of the order by the carrier, the customer undertakes to make the necessary efforts to enable the delivery of the package: name visible on the mailbox, transmission of the digital code, telephone number.
7.3 Place of delivery
The products are delivered to the delivery address indicated by the Customer on their order form.
7.4 Product conformity
The Customer undertakes to verify that they have received a complete and compliant order at the time it is delivered. HYLÉRIA will consider any order received by the Customer against signature as complete and compliant. If the product does not conform to the order, the Customer must submit a complaint to HYLÉRIA in order to obtain a replacement of the product or possibly the cancellation of the sale.
7.5. Transfer of ownership
From the delivery date indicated in the order form, ownership of the product is transferred to the Customer, except in the case where full payment of the price has not been collected at the time of ordering.
Article 8: Return and right of withdrawal
The Customer has a right of return of fourteen days from receipt of his order to return any item that does not suit him and request an exchange or refund, with the exception of return costs which remain his responsibility.
The right of withdrawal can be exercised with HYLÉRIA customer service, by email (contact@hyleriaparis.com) or by post (HYLÉRIA – PSL, 33 rue Censier, 75005 Paris).
Returns must be made in their original and complete condition, allowing them to be resold as new. Any product opened or damaged by the consumer will not be accepted. HYLÉRIA reserves the right to determine whether the product can be resold or not, based on its quality standards.
In the event of withdrawal, HYLÉRIA will refund all payments received. This will be done either by re-crediting the consumer's bank card or PayPal account, or by bank transfer, depending on the payment method used for the order.
HYLÉRIA will only refund returned products once they have actually been received and their intact condition has been verified.
Article 9: Intellectual Property
All visual, audio, or textual elements visible on the site are the exclusive property of HYLÉRIA. Any reproduction or representation of the HYLÉRIA brand is prohibited.
All elements of the HYLÉRIA website (https://hyleriaparis.com), whether visual or audio, including software, all intellectual property rights such as trademarks, service marks, design marks and copyrights are and remain the exclusive property of HYLÉRIA. Reproduction of any page or content is subject to prior written authorization from HYLÉRIA. For more information on the intellectual property of the Site, the Customer is invited to consult the Confidentiality Policy which forms an integral part of these General Conditions of Sale.
Article 10: Personal data
In accordance with the French Data Protection Act of 6 January 1978 and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, the Customer's personal information may be subject to automated processing by HYLÉRIA. For further information on the processing of the Customer's personal data, the Customer is invited to consult the Privacy Policy which is an integral part of these General Terms and Conditions of Sale.
Article 11: Disputes and claims
In the event of a dispute, the Customer must contact HYLÉRIA customer service by email (contact@hyleriaparis.com) or by post (HYLÉRIA – PSL, 33 rue Censier, 75005 Paris) in order to attempt to resolve this dispute informally.
If the complaint request to customer service fails or if there is no response within three months, the Customer may submit the dispute with the Seller to the FEVAD E-Commerce Mediation Service (http://www.mediateurfevad.fr/) which will attempt, in complete independence and impartiality, to bring the parties together with a view to reaching a solution. HYLÉRIA and the Customer remain free to accept or refuse recourse to dispute resolution through mediation and to accept or refuse the solution proposed by the mediator.
HYLÉRIA cannot be held responsible for damages resulting from improper use of its products.
Article 12: Applicable law and competent jurisdiction
This contract and the General Terms and Conditions governing it are subject to French law. In the event of a dispute, only the Commercial Court of Paris will have jurisdiction.
